Dear researcher

My question concerns the book *Bahnwärter Thiel*. At the end, following the murder of his wife and child, Thiel is labelled as mad without much scrutiny and taken to a psychiatric hospital.

I found this conclusion hard to understand, as the people around Thiel know far less about him than the readers do. Consequently, this should actually be a first-rate murder case. Is this explained in any way, or is it simply a stylistic device? Unfortunately, my teacher could only give me a vague answer.

thank you very much for your interesting question, which touches on one of the central themes that Hauptmann addresses in his ‘novelistic study’.

In fact, Thiel’s “punishment” – that is, his committal to a psychiatric institution – is dealt with in just two sentences right at the very end. However, Thiel’s guilt is never in doubt – that is to say, unlike in a classic crime novel, the focus is not on who committed the crime – rather, from the very beginning, the focus is entirely on the question of how the crime came about.

The fact that Thiel is not convicted of murder at the end, but is instead committed as a person with a mental illness, is likely due to the fact that he is classified by the authorities as not of sound mind and therefore not criminally responsible. The issue is not guilt in the sense of perpetration, but the perpetrator’s capacity to be held responsible, i.e. whether the perpetrator can be held responsible for his actions at all due to his mental state.

In Hauptmann’s portrayal, Thiel exhibits symptoms of mental illness (such as hallucinations) and finds himself in an acute crisis following the death of his elder son; by the end, he is described as ‘insane’ and ‘sick’. Even today, criminal law provides that, where a lack of criminal responsibility has been established, a therapeutic measure may be ordered in place of a sentence.

However, it should be noted that the text ultimately leaves open whether Thiel will remain in long-term psychiatric care or whether he will still stand trial – a trial in which, however, his mental capacity or criminal responsibility would very likely also be assessed.
